TERMS & CONDITIONS – SIMPLE HOLIDAYS PTE LTD

1. General

Please read these terms and conditions of use (Terms & Conditions) before using this website and making any booking. If you disagree with any part of the Terms & Conditions please do not proceed to use the website in any way or make a booking. By proceeding with your booking, you indicate your agreement to be bound by these Terms & Conditions.

2. Definitions

“Hotel" means the premises for which your booking is made. “Package" means a combination of flight plus Hotel sold at an inclusive price in a single booking. The terms "we", "us" and "our" refer to Simple Holidays Pte Ltd.

3. Third Party Suppliers

We act solely as an agent or intermediary in making arrangements for flights, hotels and other non-flight services, and have no contractual liability to you in respect of such services reserved through us. This means that the contract for flights, hotels and other services is between you and the respective supplier. Each of these flight, hotel and other service suppliers will have their respective terms and conditions relating to their services and as such, please ensure that you have read, understood and are agreeable to said terms and conditions before completing your transaction on this website.

4. Personal Data

When you buy anything from this website we may need to collect information about you to process the transaction, fulfill your order and provide you with the services requested. This information may include, but is not limited to, details such as your name, your address, your phone number and your credit card details. We may pass essential booking details and your personal data to the flight, hotel or other suppliers in order to guarantee your booking. The placing of an order for any services by you will constitute consent to us passing on such details.

By disclosing your personal information to us using this website or over the telephone, you consent to the collection, storage and processing of your personal information by us in the manner set out in these Terms & Conditions. You must make sure that all the information you provide us is true and accurate. You undertake to us that the details you give to us are correct and that the credit or debit card you are using is your own. We shall not be liable for and shall be indemnified by you in respect of any loss or third party claims (including any cancellation fees) suffered as a result of any incorrect or incomplete details in your booking. If there are any changes to the details supplied to us by you it is your responsibility to inform us about it as soon as possible.

5. Health and Immigration

You must ensure that you have a valid passport and any necessary visas to enter any country you are visiting, including transit stops, prior to your departure. It is your responsibility to ensure that you are fit to travel and participate in all parts of the services you have booked and undertake. It is also your responsibility to ensure that you can prove you have any necessary vaccinations for your travel arrangements. Consult your doctor about any health requirements for all destinations to which you are travelling before your departure. We are not liable if you are refused to any country or part of a country because you cannot prove that you have the necessary vaccinations or because you do not comply with the health requirements of your destination.

6. Booking of a package with flights

Except otherwise stated, your booking is non-refundable. Changes or cancellations to your flights can be made only as permitted by the fare rules of the flights you have purchased and charges may apply. All flight travel pursuant to your booking on this website shall be subject to the flight operator's prevailing policies, regulations and conditions of carriage as may be set out in the respective tickets purchased under your booking or such other document evidencing the same, unless expressly notified otherwise by us.

Any name or destination changes to your package are not permitted.

7. Changes or Cancellations by you to your Package and Hotel booking

Date and Time changes to a Package may be permitted but only in accordance with the rules of the individual components making up the package, and are subject to availability. Any charges and penalty fees associated with changing your Package will be borne by you.

Room Type changes to a Package may be permitted but only in accordance with the rules of the Hotel provider, and are subject to availability. Any charges and penalty fees associated with changing your Package will be borne by you. In addition we reserve the right to charge you an administrative fee of SGD$50 per booking for making any changes to your booking. Changes can only be made through our dedicated hotline +65 6701 1301

8. Booking Confirmation

Your contract for a Package is formed only when you have successfully paid for the Package and have received an email from us confirming acceptance of your booking. The confirmation email will contain details of your booking, flight itinerary and a hotel voucher. If you do not receive a confirmation email within 30 minutes of your booking please contact us via our dedicated hotline +65 6701 1301. Please print out the confirmation email and present it at both the airport and hotel during check-in. Some Hotels require guests to provide additional photo id during check-in, it is your responsibility to provide this where necessary.

Your contract for Hotel bookings as a separate item arises between you and the Hotel only when our appointed agent, GoQuo Pte Ltd have received full payment from you on behalf of the Hotel(s) and a confirmation email has been sent to you from us on behalf of the Hotel.

Your contract for Hotel bookings as part of a package arises between you and the Hotel only when our appointed agent Tiger Airways Singapore Pte Ltd have received full payment from you on behalf of the Hotel(s) and a confirmation email has been sent to you from us on behalf of the Hotel.

Your contract for flight bookings as part of a package arises between you and the flight operator only when our appointed agent Tiger Airways Singapore Pte Ltd have received full payment from you on behalf of the flight operator and a confirmation email has been sent to you from us on behalf of the flight operator.

9. Contact Information

It is essential to ensure that you or the person making your booking advises us of an email address and telephone number where you can be reached if necessary before and after your departure. We may leave messages for you on the number(s) you provide.

10. Complaints

Any complaints regarding the flight, hotel and other services should be directed to the relevant service provider immediately. We will not be liable to you for any problem which could have been rectified during your use of the flight, hotel and other services or if the service supplier had been made aware of it. In any event, you should inform us of your complaints within 21 days of the event giving rise to the complaint.

11. Events Beyond our Control

We shall not be liable to you due to our inability to fulfill the booking by reason of any fire, earthquake, flood, substantial snowstorm, epidemic, explosion, strikes, riot, civil disturbance, war, any failure or delay of any transportation, power or communications system or any similar events which are beyond our control or the control of the service suppliers for flights, hotel and other services.

12. Star Ratings

There is no consistent global system of hotel and accommodation star ratings. Different countries have different standards; a 3 star hotel in one country is not necessarily equivalent to a 3 star hotel in another. Therefore we have set our own star ratings to provide a standard which can be compared globally and offer them as general guide only. However, these are not necessarily the official local rating and you should be aware that standards can vary between hotels and accommodation of the same class in different countries and even in the same country.

13. Product Description

Images, amenities, facilities and descriptions are provided to give general information about the property. Whilst we endeavor to ensure that property amenities, facilities and descriptions offer accurate and up to date information, we obtain this information from our third party e-retail platform service provider. We do not guarantee any particular standard or class of accommodation or other service provided by third party. Images of room types do not necessarily represent the bed configuration of the room being purchased.

14. Special Assistance and Requests

Special requests such as non-smoking, adjoining or interconnecting rooms should be made directly to the Hotel itself.

15. Correct Details

Bookings must not be made with fictitious names to hold a space. If you do not book with the correct name you may receive non-arrival charges.

16. Charges

If a Hotel levies an energy surcharge, a resort fee or a local telephone service charge you must pay such charges directly to the Hotel. Please also note that there may be taxes levied abroad but not paid at the point of purchase that are payable in relation to your Hotel booking e.g. local taxes, sales tax etc. Any such taxes must be paid by you directly to the Hotel at the time of check-in/checkout.

17. Payment Terms

Most hotels require a major credit card to be provided upon check in to cover incidentals. In the absence of a credit card a cash deposit may be required. All extras incurred by you must be paid directly to the Hotel before departure; we will not be liable for your personal Hotel charges. Upon acceptance/payment of your booking we will send you a confirmation email which includes a Hotel voucher. You should print out the voucher and present upon check in at the Hotel. You may not be allowed to check in without the confirmation letter/ voucher or may be charged directly if you fail to present the confirmation letter/voucher.

18. Proof of Identification

Please bring the card used for purchase of your booking along with valid photo ID. This must be presented during check-in. Failure to do so may result in your reservation not being honored.

19. Liability Disclaimer

To the extent permitted under applicable law, we shall not be held liable for any direct, indirect, special, or other consequential damages, whether stated in contract, tort, strict liability or otherwise, arising out of (a) the acts or omissions of any person rendering flight, hotel or other services in connection with the Package (b) any failure or delay or performance by any person or company rendering flight, hotel or other services; (c) any failure or delay arising out of use of this website, including, error, omission, interruption, defect, delay in transmission, or computer virus; (d) any failure or delay arising out of use of a person or company rendering flight, hotel or other services’ websites. We act as an agent and are only responsible for providing services of facilitating the booking of and payment for the Package.

We do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the flights, Hotels and other related services displayed on this website (including, without limitation, the pricing, photographs, list of hotel amenities, general product descriptions, etc.).

The suppliers providing flights, hotel accommodation and other services on this website are separate legal entities and are not agents or employees of us. We are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting there from. We are not liable for any costs, expenses, claims or damages arising out of any services to recover any of the foregoing, including without limitation relocation costs.

If, despite the limitation above, we are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then our liability will in no event exceed, in the aggregate, the fees you have paid to us in connection with such transaction(s) on this website.

20. Miscellaneous

We reserve the right to change these terms and conditions at any time and without notice to you unless notice is required by law.

21. Links to Third Party Websites

Our website may contain electronic links to websites owned and operated by third parties. Such links are provided for your convenience and reference only. We do not own, operate or control the content of these websites. Our inclusion of any links does not imply an endorsement of their material or content and we disclaim any liability arising out of your use of such websites.

22. Destinations Passengers Enquiries

We make no representation as to the safety, conditions or other issues that may exist at any destination.

23. Governing Law

This Agreement and the transactions contemplated by this Agreement are governed by the law in force, in Singapore.
